1. Eligibility
The Music Theatre International Survey Sweepstakes (the “Promotion”) is open only to legal residents of the fifty (50) United States (including District of Columbia) who are 18 years or older at the time of participation. Void in Guam, Puerto Rico, the U.S. Virgin Islands, and other U.S. territories and possessions and where prohibited by law. Individual contestants must be affiliated with an accredited school or other organization that has a customer account with Music Theatre International (“MTI”) and are deemed to enter on behalf of their organizations. Employees of MTI any of its employees, affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Promotion and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Promotion is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsors’ decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Promotion consists of a sweepstakes (the “Sweepstakes”).
2. Sponsor
MTI Enterprises, Inc. d/b/a Music Theatre International, 421 West 54th Street, New York, NY 10019 (“MTI”).
3. Timing
The Promotion begins on June 15, 2016 and ends on June 24, 2016 at 11:59 p.m. ET (the “Promotion Period”). MTI’s computer is the official time keeping device for this Promotion.
4. How To Enter
To be eligible for the Promotion, during the Promotion Period, you must click on the MTI survey link in the email you received from MTI regarding the survey, follow the link to SurveyMonkey website and complete the survey online. Once at the survey, you should answer all of the questions provided. Entrants must complete all required information, including your contact information at the end of the survey All individuals completing the survey will be entered to win. Click on the link and follow the instructions to enter to win. If you do not complete the steps necessary to complete your entry, your Entry may not be valid Entries must comply with all applicable laws, rules, and regulations. Sponsors shall have no obligation to copy, publish, display, or otherwise exploit any Statement.
You also may enter the Promotion by printing (in the following order) the words “MTI Survey Sweepstakes,” your full name, street address, email address (if any), city, state, zip code, and telephone number on a standard 4″ x 6″ postcard and mail it to: Music Theatre International Survey Sweepstakes, 421 W. 54th Street, New York, NY 10019, Attention: Marketing Department (“Mail-in Entry”). Mail-in Entries must be postmarked within the Promotion Period and received within 7 days of the end of the Promotion Period. Each Mail-in Entry must be mailed separately. A representative of Sponsor will create an entry on your behalf for every valid Mail-in Entry received. You will be notified by email, telephone, regular mail or overnight mail, if you are a potential winner. LIMIT ONE (1) MAIL-IN ENTRY PER PERSON.
Entries must be received before June 24, 2016 at [9:00 PM ET] to be eligible for the Sweepstakes. Sponsors' computer shall be the official timekeeper for all matters related to this Sweepstakes. Limit one (1) Entry per person during the Sweepstakes Period. Multiple Statements received from any person or email account beyond this limit will void all such additional Entries. For purposes of these Official Rules, a “day” will start at 12:00:01 AM ET and end at 11:59:59 PM ET. Entries/Statements that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the email account used to enter will be deemed to be the entrant.". Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.
5. Winner Selection
Approximately one (1) week after the conclusion of the Promotion Period, Sponsor or an independent judging agency will select one (1) entry for the Grand Prize described below in Section 8 in a random drawing of all valid entries received. The entrant will be contacted using the email address, mailing address and/or phone number provided with the entry and may be awarded the prize (subject to verification of eligibility and compliance with the terms of these rules). Sponsors’ decisions as to the administration and operation of the Promotion and the selection of potential winners are final and binding in all matters related to the Promotion. The potential Grand Prize winner is subject to verification as provided in Section 7 below.
6. POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION.
7. Verification of Potential Winners
Sponsors will make two (2) attempts to notify potential Winners via the email address or phone number used at the time of Entry. Potential Winners may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Sweepstakes Documents”) within one (1) days of such notification. Noncompliance within this time period will result in disqualification, and, at Sponsors’ sole discretion an alternate potential Winner may be selected from the remaining eligible Entries. If a potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if prize or prize notification is returned as undeliverable, potential Winner will be disqualified and time permitting, at Sponsors’ sole discretion, an alternate potential Winner may be selected from the remaining eligible Entries.
Potential winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. A potential winner may be required to provide the Sponsors with documentation that shows he or she was an eligible participant. Potential winners will be notified by email, telephone, or mail after the date of random drawing. If a potential winner of any prize cannot be contacted, fails to sign and return any required documentation within the required time period (if applicable), or if the prize notification is returned as undeliverable, potential winner forfeits prize.
8. Grand Prize
Five (5) Grand Prizes will be awarded and will consist of one free MTI Rental Certificate. The Rental Certificate is good for one free Standard Rental up to $1,000 value. Does not include additional rental (i.e. early rental, additional resources, etc.). MTI will notify the winner and mail a hard copy of the Rental Certificate, which is valid for one year.
One entry per user. One (1) winner will be selected through a random drawing and notified through email.
The Grand Prize is non-transferable and no substitution will be made except as provided herein at the Sponsors’ sole discretion. Sponsors reserve the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning depending on the number of entries received during the Promotion Period. Approximate retail value of the Grand Prize is $1,000.
All taxes and other expenses, costs, or fees associated with the acceptance and/or use of the Grand Prize are the sole responsibility of Winner. The Grand Prize cannot be transferred by Winner or redeemed for cash and are valid only for the items detailed above, with no substitution of Prizes by Winner. If the Grand Prize is unclaimed within a reasonable time after notification from Sponsors, as determined by Sponsors in their sole discretion, it will be forfeited, and time permitting, an alternate Winner maybe selected from the remaining eligible entries at Sponsors’ sole discretion.
Sponsors shall have no responsibility or liability for cancellations, delays, or any other change by any company or person providing any element of the Grand Prize due to reasons beyond Sponsors’ control, and are not responsible or liable for any expenses incurred as a consequence thereof. Date and/or time of event are subject to change. Event is subject to postponement or cancellation.
9. Entry Conditions and Release
By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Sweepstakes judges which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsors and each of its respective parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes and Promotion, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Sweepstakes and Promotion, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsors from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Sweepstakes and Promotion and/or entrant’s acceptance, use or misuse of prize.
10. Publicity
Except where prohibited, participation in the Promotion constitutes winner’s consent to Sponsors’ and its agents' use of winner's name, likeness, photograph (including any photos submitted as part of the promotion), voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
11. General Conditions
Sponsors reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsors’ reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsors in their sole discretion. Sponsors reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsors reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsors’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Limitations of Liability
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Sweepstakes play, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsors, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prize offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsors reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
13. Disputes
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of winner, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court located in New York County, New York; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
14. Entrant's Submissions Personal Information
Information collected from entrants is subject to MTI’s Privacy Policy, which is at http://www.mtishows.com/privacy-policy, and MTI’s Terms & Conditions which is at http://www.mtishows.com/legal. By entering, entrant represents that entrant has the right to post any statements or photos submitted.
15. Additional Terms
Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at Website [http://www.mtishowspace.com/]. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner(as determined by Sponsors in their sole discretion).
16. Promotion Results
For Promotion results and/or a copy of these Official Rules, send a hand-printed, self-addressed, stamped envelope to the Music Theatre International Survey Sweepstakes Winner List, MTI Enterprises, Inc., 421 West 54th Street, New York, NY 10019. Requests for the winner list must be received by June 24, 2016.
